A group of southern Illinoisans could learn by Friday whether their request for a preliminary injunction to block the state's fracking rules from being published will be granted by a Madison County judge. Once the rules are published in the Illinois Register, fracking can begin in the state.
Last week, residents and environmentalists filed a lawsuit, arguing the state's fracking rulemaking "violated mandatory statutory and administrative rulemaking procedures and is therefore invalid." They are seeking a preliminary injunction that "directs the IDNR to renew the rulemaking process" for the state's fracking regulatory act.
Arguments in the case were heard Tuesday, and Madison County Judge Barbara Crowder is expected to issue a ruling by Friday.
