Chicago Mayor Rahm Emanuel filed a notice of appeal Friday on a decision Circuit Court Judge Thomas More Donnelly made a day before to dismiss the October 2011 arrests of 91 Occupy Chicago protesters. Protesters were arrested for violating the Chicago Park District's 11 p.m. Grant Park curfew. Donnelly ruled that such a curfew had been arbitrarily enforced. The judge noted that people celebrating President Barack Obama's 2008 election victory stayed at Grant Park past 11 p.m. with no legal consequences.
Emanuel said at a press conference Friday that this was an "apples and oranges" comparison partly because protesters, Emanuel said, planned to stay at the park overnight. Emanuel has often praised the behavior of the Chicago Police Department in responding to Occupy Chicago protesters.
