Associate Judge Thomas Donnelly threw out today the October 2011 arrests of 92 Occupy Chicago protesters for violating the Chicago Park District's curfew. Donnelly argued that police were inconsistent in citing the curfew violation, because they don't issue arrests for city-supported events such as President Barack Obama's 2008 election night rally.
The Chicago Tribune notes that the ruling is a blow to Mayor Rahm Emanuel, who has highlighted the arrests as an example of how the city maintains law and order, while respecting protester's rights. The city indicated that they would appeal the ruling.
